Enctosed please find herewith a copy of OA No. 352/2022 before The Hon'ble CAT
Mumbai filed by Shri Dhanaji D. Hulwan & Ors v/s The U.O.t & Ors along with Notice dated
L7.Ai6.2022 issued by Registrar CAT Murnbai. Same was received in this office by RpAD on
0L.06.2022.
The Applicants submits that they are working as ESM-ll in S&T Dept and had
submitted a representation dated 02.02.2A22 to DRM{P)Pune requesting for their
promotion orders to be issued to the post of ESM-I w.e.f. L4.AL.ZAZZ as they have
completed the requisite 02 years residency period in ESM-lll. However DRM{p}pune issued
Corrigendum dated 09.03.2022 whereby it was informed that the names of applicants have
been removed from the panel'of ESM-I on the grounds that seniority list of ESM-ll is
incorrect. Further the DRM(P)Pune deciding representation dated OZ.A2.ZAZ2 submitted by
applicants informed vide letter dated 15.03.2022 that their names have been removed from
the panel of ESM-|.
Aggrieved by the above the applicants have approached CAT Mumbai and filed said
OA No. 35212A22 praying to declare the applicants being found suitable for promotion to
the post of ESM-Iw.e.f. L4.CIt.2122. This matter is posted for hearing on 20.06.202A.
Now in connection to your letter under reference, it is requested to engage Counsel
from the Panel of Ministry of Law & Justice Department to contest the case on behalf of
Railway Administration.
ln view of the above, it is therefore advised to intimate the name of the nominated
Panel Advocate from the Panel of Ministry of Law & Justice Department of Legal Affairs.
