• (^) Türkiye Cumhuriyeti Hükümeti ile Rusya Federasyonu Hükümeti Arasında Gümrük Konularında Karşılıklı Yardım ve İşbirliği Anlaşması
• (^) Agreement Between the Government of the Republic of Turkey and the Government of the Russian Federation Regarding Co- Operation and Mutual Assistance in Customs Matters

• (^) Taraflar olarak adlandırılan ile Türkiye Cumhuriyeti Hükümeti ile Rusya Federasyonu Hükümeti;
• (^) Gümrük mevzuatına aykırılıkların devletlerin meşru ticari çıkarlarına olduğu kadar, ekonomik, sosyal ve mali çıkarlarına zarar verdiğini dikkate alarak;
• (^) The Government of the Republic of Turkey and the Government of the Russian Federation, hereinafter referred to as the Parties;
• (^) Considering that offences against customs legislation are prejudicial to the economic, fiscal and social interests of their respective countries as well as to the legitimate interests of trade;

• (^) Gümrük mevzuatına aykırılıkların önlenmesi, ithal ve ihraç vergi ve resimlerinin doğru olarak tahsil edilmesi çabalarının gümrük idarelerinin yakın işbirliği ile daha etkin olacağından emin olarak;
• (^) Convinced that efforts to prevent offences against customs legislation and efforts to ensure accurate collection of import and export duties and taxes can be made more effective through co-operation between their Customs Authorities;

• (^) Uyuşturucu ve psikotropik maddelerin yasa dışı trafiğinin halk sağlığı ve toplum için tehlike oluşturduğunu göz önünde bulundurarak;
• (^) Considering that illicit trafficking in narcotic drugs and psychotropic substances constitutes a danger to public health and to society;

• (^) Birleşmiş Milletler Teşkilatının himayesinde düzenlenmiş bulunan; 1961 tarihli Uyuşturucu Maddeler Tek Sözleşmesi, 1971 tarihli Psikotropik Maddeler Sözleşmesi ile 1988 tarihli Uyuşturucu ve Psikotropik Maddelerin Yasa Dışı Trafiğinin Önlenmesi Sözleşmesi hükümlerini de göz önünde bulundurarak;
• (^) Aşağıdaki hususlarda anlaşmışlardır.
• (^) Having regard also to the provisions of the Single Convention on Narcotic Drugs, 1961, the Convention on Psychotropic Substances, 1971 and the Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, 1988 all drawn up under the auspices of the United Nations Organization;
• (^) Have agreed as follows:

• (^) Bu Anlaşmanın uygulanmasında;
• (^) 1. "Gümrük Mevzuatı" deyimi; Gümrük İdaresi tarafından uygulanan; eşyanın ithalatı, ihracatı, transiti, gümrük vergi, resim ve harçları ile ilgili olsun veya olmasın ödeme şekli veya yasaklama, kısıtlama ve kontrollere ilişkin tedbirlerle ilgili yasa ve yönetmeliklerde yer alan hükümleri;
• (^) For the purposes of this Agreement.
• (^) 1. "Customs legislation" means provisions laid down by laws or regulations concerning the importation, exportation and transit of goods and means of payment, whether relating to customs duties, taxes and other charges, or to measures of prohibition, restriction or control, enforced by the Customs Authorities.

• (^) 3. "Gümrük İdaresi" deyimi, Türkiye Cumhuriyeti'nde Başbakanlık Gümrük Müsteşarlığını; Rusya Federasyonu'nda Devlet Gümrük Komitesi'ni; İfade eder.
• (^) 3. "Customs Authority" means in the Republic of Turkey, Prime Ministry Undersecretariat for Customs, in the Russian Federation, the State Customs Committee of the Russian Federation.

• (^) ANLAŞMANIN KAPSAMI
• (^) 1. Taraflar, Gümrük İdareleri aracılığıyla bu anlaşma hükümleri uyarınca;
• (^) a) Eşya hareketini hızlandıracak ve kolaylaştıracak önlemleri alırlar.
• (^) SCOPE OF AGREEMENT
• (^) 1. The Parties, through their Customs Authorities, shall in accordance with the provisions set out in this Agreement:
• (^) a) undertake measures in order to facilitate and expedite movement of goods;

• (^) c) Gümrük mevzuatının uygulanmasında kullanılacak bilgileri talep üzerine temin etmek konusunda birbirlerine yardım ederler.
• (^) c) upon request, assist each other by providing information to be used in administering and enforcing the customs legislation;

• (^) d) Yeni gümrük işlemleri konusundaki araştırma, geliştirme ve test işlemleri, eğitim ve personel değişimi ile tarafların ortak hareketini gerekli kılabilecek diğer konularda işbirliği için gayret ederler.
• (^) d) endeavour to co-operate in the research, development and testing of new customs procedures, in the training and exchange of personnel and in other matters that may require their joint efforts; and

• (^) 2. Bu maddenin 1-b ve c alt paragraflarında belirtilen yardımlar, sadece adli, idari işlemler veya bu Anlaşma'da belirtilen diğer amaçlar için kullanılabilir.
• (^) 2. Assistance mentioned in subparagraphs 1. b and c of the present Article can only be used for the judicial, administrative proceedings or for the other purposes specified in this Agreement.

• (^) 3. Bu anlaşma çerçevesindeki karşılıklı yardım, talepte bulunulan ülkede yürürlükte bulunan mevzuata uygun olarak ve talepte bulunulan gümrük idaresinin yetki ve kaynakları dahilinde yerine getirilir.
• (^) 3. Mutual assistance within the framework of this Agreement shall be rendered in accordance with the legislation in force in the territory of the State of the requested Party and within the competence and resources of the requested Customs Authority.
