Prison reforms in india :-
Prison reforms in india is a much debated subject matter and
have been the lint of discourse for many committees appointed
by the government of India.
Despite many suggestions made with respect to prison reforms
remains gloomy and stagnant.
Macaulay’s minutes of 1835 laid down the foundation of prison
system in india as we see it today.
Prison is a state subject.
Case laws :-
Nilabati Behera Vs state of Orissa.
The letter was sent to the Supreme Court by Smt Nikabati
Behera.
Suman Behera was taken from his home in police custody, in
connection with the investigation of theft and detained at the
police station.
Later, the petitioner came to know that the dead body of her son
Suman Behera was found near the railway track.
The petitioner alleged in her latter – that it was a case of
custodial death.
Issues :-
Whether the petitioners son died in police custody due to police
brutality ?
Whether the petitioner is eligible for compensation?
Petitioner prayed that due compensation should be paid to her for the
violation of fundamental rights under article 21 of the constitution
