Dear Sir,
Under instructions and authority from my client Vinay Prakash Tiwari S/O Late Jay Prakash Tiwari R/O :
Bahadurpur PS: kotwali District Ballia Uttar Pradesh India ,I serve upon you the following legal notice.
1. That My aforesaid client approached you for construction and repairing of aluminum work at his
site on 05.01.2022 and during that visit you had urgent need of money for your business or
personal reason.
2. That my client cleared your full bill amount. Also, as per your request for your dire necessity he lend
you Rs.200,000 Two lakh @ 2% per month .
3. That you had promised to repay the principal amount of Rs.200,000 and interest accrued within
eight months and for security issued a cheque of Rs.200,000 cheque no.082748 dated 01.08.2022
drawn on State Bank of India from saving A/c no 30249371809 Branch Ballia city MalGodam, chowk
Ballia Dist-Ballia Uttar Pradesh pin:277001
IFSC Code: SBIN0002517.
4. That my client had relied on your promise and as instructed by you deposited the cheque in his
saving bank account number A/c=31022465712 IFSC=SBIN0000017 Branch=Middhi Ballia
5.That the aforesaid cheques No. 082748 dated 01.08.2022 for Rs.2,00,000/- was presented by
my client Vinay Prakash Tiwari on 29.10.2022 to your bankers i.e. State Bank of India.

  1. That to my clients' shock and surprise the said cheque had been dishonored by your bankers with the reason “Fund Insufficient” and “Drawer’s Signature Differs” which was intimated to my client by his Banker through their cheque return memo dated 31.10.2022.
  2. That thereafter in spite of many telephonic reminders by my client, you failed to make the payment due to my client.
  3. That it is now clear that you had the dishonest intention at the time of borrowing money from my client and deceived my client to the tune of 200,000.
  4. My client states that you have issued the above said cheques only with an intention to cheat my client which amounts to an offence punishable under section 138 of Negotiable Instruments Act and 420IPC
  5. Under the circumstances, we call upon you to pay of Rs. 232000 /- within a period of 15 (fifteen) days from the date of receipt of this notice, failing which our client will be constrained to take legal action against you in a court of law for an offence punishable under section 138 of Negotiable Instruments Act and 420 IPC for which you will be liable for all costs and consequences.
  6. This is without prejudice to all other legal rights and remedies available to our client for the above-stated purpose.
  7. You are liable to pay a sum of Rs. 5000/- as necessary cost and expenses of sending the present legal notice to you.
