Rashid has just opened “Bakers Pride” in tejaji Nagar indore and, anxious to gain popularity,
decides to put an advertisement in the local paper providing for sale of boxes of luxury chocolate
“Sweet Tooth” at a discount price of 100/-, instead of the recommended retail price of 200/-.
The advertisement stated that there are only 20 boxes available. And also provided that anyone
wanting the “Sweet Tooth” should contact Rashid in person at the shop or E-mail him at
Rashid@BakersPride.com or visit at www.BakersPride.com. The advertisement appears in the
local paper on 11-09-2021. Rupali sees the advertisement at 4.30 pm on the 11-09-2021
afternoon and immediately sends an Email to Rashid ordering six boxes of the “Sweet Tooth”.
The e-mail is received on Rashid‟s machine at 5.09 pm on 11-09-2021. On 11-09-2021 evening
Rashid realizes that the discount was too generous as he is making no profit because of the
discount on the “Sweet Tooth” and people are not coming to the shop and buying lots of other
products as he had hoped.
He asks the local paper to put notice in the next day issue informing people that the discount
price is no longer available. Rupali being excited for the discount still seemed restless after
sending the mail. And in the night, she logs on to the Bakers Pride website and selects the „Sweet
Tooth‟ Offer and goes to the offer page. There she selects to buy two boxes and proceeds to the
payment page. There she enters her Credit Card details and submits for payment of a total of Rs.
200/-. The processing of the payment takes place, but she does not receive any SMS of the
payment being made. Her account is not debited of the amount. paper is published at 9 am on 12-
09-2021 morning and it is delivered to Rupali at 10.30 am. Rashid opens for business at 10.00am
on the 12-09-2021. He reads Rupali's E-mail at 10.35 am, but refuses to sell her the “Sweet
Tooth”. He replies stating that the discount is no longer available. Rupali does not even receive
the order of two boxes made on the website. Rupali decides to sue Rashid for breach of contract.
