INTRODUCTION
One of the most important aspects of a job for most workers is salary or wages being paid. Wages enable them to earn a living from their work; they also provide incentives to be productive and loyal to the employer. According to Black’s Law Dictionary, Wages means, “A compensation given to a hired person for his or her services; the compensation agreed upon by a master to be paid to a servant, or any other person hired to do work or business for him.” Wages are defined under various acts of Labor Law such as Factories Act, 1948; Minimum Wages Act, 1948; Payment of Wages Act, 1936; Payment of Bonus Act, 1965; and The Industrial Disputes Act, 1947. In this assignment, we will be critically analyzing the definition of Wages under The Industrial Disputes Act of 1947. Along with it, we will also compare the definition of wages under different acts as well with important case laws.
DEFINITION OF WAGES
Section 2(rr) of The Industrial Disputes Act, 1947 defines Wages: “Wages” means all the remuneration capable of being expressed in terms of money , which would, if the terms of employment, expressed or implied were fulfilled, to be payable to a workman in respect of his employment or of work done in such employment. Wages include: i. Such allowance (including Dearness Allowance) as the workman is for the time being entitled to; ii. The value of any house accommodation, or of supply of light, water, medical attendance or other amenity or of any service or of any concessional supply of food grains or other articles; iii. Any travelling concessions; iv. Any commission payable on the promotion of the sales or business or both. Wages does not include: a. Any bonus; b. Any contribution paid or payable by the employer to any pension, fund or provident fund or for benefit of the workman under any law for the time being in force; c. Any gratuity payable on the termination of service of workman. Kinds of Wages : There are three types of wages:
1. Fair Wages: -In this wages, workmen gets payment. He can also enjoy all the luxuries even though his work is inferior. Developed country pay fair wages. 2. Living Wages: -In living wages there is better payment but it is less than fair wages. In living wages also workmen can get partial luxuries. Developing countries are paying living wages.
